The New Mexico Court of Appeals denied an appeal by former New Mexico Republican Party treasurer and perennial candidate Kimberly Skaggs to be released from jail pending trial following her arrest for th the fatal hit-and-run death of a bicyclist in Doña Ana County.
A district court judge had ordered Skaggs held without bail pending trial but she appealed that decision. The New Mexico Department of Justice argued that she should remain in custody pending trial based on the facts and circumstances presented to the district court. After Skaggs appealed the detention order, the Court of Appeals reviewed the record and affirmed the district court’s ruling, allowing the pretrial detention order to remain in effect.
The case will now proceed in the Third Judicial District Court. No trial date has been set.
