A 38-year-old man faces multiple charges, including attempted burglary and battery, following a domestic violence incident in Torrance County, according to a criminal complaint filed Wednesday in magistrate court.

The Torrance County Sheriff’s Office responded to a domestic violence call at approximately 9:24 a.m. on Nov. 11 in Moriarty, according to the affidavit.

The complaint charges the suspect with attempted burglary of a dwelling house, a fourth-degree felony, along with misdemeanor battery against a household member and petty misdemeanor assault against a household member, court documents show.

According to the affidavit, the victim told deputies she had been in a physical altercation with her boyfriend at his Estancia residence early that morning. The victim reported the suspect accused her of infidelity around 4 a.m., then became physical, grabbing her by the shirt and pushing her, causing her to fall to the floor, court documents state.

The victim said she left with her son and returned to her home in Moriarty, but the suspect followed her approximately five to 10 minutes later.

Deputies later conducted a follow-up interview with the victim at her residence, where she provided additional details about the incident.

When the suspect arrived at the victim’s home, he disconnected a security camera located on the porch before beginning to beat on the front door and living room window, demanding to be let inside, according to court documents.

The victim said she feared he would break in and barricaded the front door with a chair and the back door with a stool, the affidavit states. The suspect could see her actions through the window and asked, “You think a wooden chair is going to stop me?” according to the complaint.

The suspect circled the house, banging on doors and windows while the victim repeatedly told him she would call law enforcement, court documents show.

During this time, the suspect sent threatening text messages to the victim, according to the affidavit. The messages included: “I could walk right through that door. You know that right?” and “Come to the window and let me say goodbye, please and I’ll leave and you won’t have to watch the cops kill me in your mom’s front yard,” court documents state.

Another text read: “You wanna see what I do when the cops come? They’ll have to kill me,” according to the complaint.

Before leaving, the suspect allegedly deflated the victim’s tire “preventing [her] from leaving the residence if she felt it necessary to do so,” according to court documents.

Officers located the suspect near the intersection of Highway 41 and Abrahames Road, where he was detained. The suspect initially refused to provide information to deputies, the affidavit states.
